Payment

YoCircle (www.yocircle.com) is contest platform to win cash awards, prizes and / or certificates. But participation in the contest is not free. Users have to purchase contest credits. Payment is linked with the number of contest credits. For example, if a user purchases two contest credits, the user will be allowed to upload only two photographs for the contest. After the uploading of two photographs in the contest, user’s wallet balance will be zero. Contest credits are also having validity. Thus, if any user doesn’t use the contest credit within stipulated time, user’s contest credit would be assumed to have been consumed and wallet balance would be zero. The functionality works, whichever is earlier which means, if the contest credit is consumed in full, wallet balance will be zero or after the expiry of the validity, the contest credit will be zero.

To make the online transaction, YoCircle (www.yocircle.com) has used and deployed services of third party payment gateway.

In no case shall YoCircle (www.yocircle.com) , its directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any loss, claim, or any direct, indirect, incidental, punitive, special, fraud, cheating, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service offered by YoCircle (www.yocircle.com) or through third party using the service, or for any other claim related in any way to your use of the service or services and / or applications provided by third party, including, but not limited to, any loss, monetary loss, loss of profit, financial damage, due to fraud and / or cheating, errors or omissions, or any loss or damage of any kind incurred as a result of the use of the service or services provided by third party applications developers or service provider do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be nil.

Third party payment gateway, may charge additional transaction fees which would be over and above the contest participation package.

Contest

YoCircle (https://yocircle.com) is basically a photography contest application on social media platform where a user can create profile, page, group, invite friends, like post, share post, comment on post and also can chat with known or strangers.

With the advent of smart phone with high resolution in-built camera, we all can become a photographer. It is said, that photography is a luck and chance. If you are present at an event site with your high resolution camera phone, you can take photograph.

What are we doing with our high resolution camera phones? Are we not clicking photographs? Yes, we are clicking photographs. Some of photographs are very excellent. But are we getting due recognition from our clicks? The answer is a big NO.

YoCircle (https://yocircle.com) is an application where you can take part in photography contest, build your network and get maximum likes, comments and share for your photograph and you can be one of winners with certificate and / or cash rewards.

Winners will be decided basis following parameters:

a. User should have purchased a package

b. Those who have received money from YoCircle in their wallet under promotional activities and if that user consume that wallet balance to take part in any of contest are not eligible to be termed as winner. Only bonafide and legitimate user who has purchased package to take part in the contest will be considered by jurry and YoCircle authority

c. User photograph must have minimum 50 unique likes and equal numbers of share and comments. Thus, after taking part in the contest, user should take initiatives to get maximum likes on the contest photograph. User should also ensure maximum unique comments and share of the photograph by building his / her own community

d. Getting mininum likes on posts doesn't guarantee that an user will be winner. This is the minimum criteria

e. User should score maximum marks from YoCircle Jury and also get maximum social score to be eligible for winner

f. Mere fulfillment of single or all criteria doesn't guarantee that the user will receive prize money in full or in proportion

g. If there are many winners, prize money will be distributed to all winners. Proportion of distribution will be decided by YoCircle team

h. In competition duration, there should be minimum 10 (ten) contestants. If there are less number of participants in a particular contest category, the contest period may get extended or YoCircle may withdraw / delete the contest with or without intimation. In that case, user can claim refund of consumed balance within 15 days

I. Deciding winners, prize money, distribution of prize money, certificate etc are full and soul discretion of YoCircle management. No question / query would be entertained in this regard.

While certificate will be emailed to you immediately after the expiry of the contest, cash rewards, if any, will be transferred to secured wallet maintained by YoCircle and you have the liberty to transfer your earned money to your bank account anytime.

For making the payment transaction smooth, YoCircle (www.yocircle.com) has opted for services of third party payment gateway provider and as mentioned above under “Payment” of this Terms And Conditions, YoCircle (www.yocircle.com) should not be held responsible for any loss or fraud during the transaction.

Disclaimer

To the maximum extent permitted by applicable law, we exclude all representations, warranties and conditions relating to our website and the use of this website (including, without limitation, any warranties implied by law in respect of satisfactory quality, fitness for purpose and/or the use of reasonable care and skill).
